EFTC Status in Kansas

The Kansas Legislature overrode Governor Laura Kelly's veto of Senate Bill 361 on April 9, 2026, opting Kansas into the federal Education Freedom Tax Credit. The House voted 85 to 38 and the Senate voted 29 to 10 to override, one day after Kelly's April 8 veto. An earlier bill, HB 2468, had failed to clear its override vote days before, but SB 361 succeeded, making Kansas the 29th state to opt in. Kansas taxpayers will be able to claim the federal credit of up to $1,700 for donations to qualified scholarship granting organizations beginning in 2027. Kansas is treated as opted-in consistent with the Kentucky precedent: a completed legislative override counts as opted-in even before the state appears on the IRS Form 15714 formal list (the IRS June 8, 2026 list of 27 states does not yet include Kansas).
