Governor Kathy Hochul (D) announced on May 7, 2026 that she plans to opt New York into the federal scholarship tax credit, making New York the largest Democratic-led state to signal participation. Her office said she will wait for the IRS to issue implementing regulations before submitting the formal election, so the opt-in is not yet final. New York has not filed IRS Form 15714. The announcement drew opposition from some legislative Democrats and the New York City teachers union.

Governor Hochul said on May 7, 2026 that she plans to opt New York into the federal scholarship tax credit, which gives donors a dollar-for-dollar federal credit of up to $1,700 for gifts to scholarship-granting organizations. Hochul's office said she will review IRS regulations before making the election official, so the opt-in is not yet formal.
