Governor Josh Stein (D) vetoed HB 87 (Educational Choice for Children Act) in August 2025. Stein supports school choice in principle but objected to funding private school choice while public education funding was being cut. The Republican-led legislature has scheduled override votes but has not successfully overridden as of April 2026.

NC Republican legislators are focusing veto overrides on immigration, guns, and DEI bills, signaling HB 87 (the federal opt-in bill Stein vetoed in August 2025) is not among their immediate override priorities. The veto remains in place as of late April 2026.
